Now I am not eligible for Medicare yet, just the senior menu's at the local restraunts but I am an Elder Law Attorney. My practice is entirely dedicated to assisting people, like you, who are in their 60's, 70's, 80's and 90's, weave their way through the maze of laws and regulations that affect them and their families. Toward the end of 2004 and in the beginning of 2005, more and more of my clients asked about Medicare Part D. They had lots of questions and concerns about the how the program was going to work and how they were going to be able to afford to pay for the program. I started to look for resources and found that there was an abundance of information about the program basics provided by Medicare but little said about the assistance programs, other than they existed. I found nothing for the public about how to become qualified to receive assistance to help pay for the costs of the Part D program. My motivation to tell about the methods to become eligible for help was intensified when I met Ann. Here is her story.
 
Ann's Story

Ann is a widow in her eighties.  She is in good health, all things considered. She lives in the home that she and her husband purchased in 1964. The same home where she raised two children and now entertains her grandchildren. Ann and George, her late husband, worked hard, paid off the house early and saved a little bit of money for retirement. Now 88 years old, Ann has $27,000 left of the savings that she and George had scraped together. Her income is only $800 per month from Social Security and she a little bit of interest each year from the bank that keeps her $27,000 in CD’s. Although by the world's standards she doesn't have much, Ann is content with her life and has long ago accepted that her resources are limited.

Ann heard that Medicare was starting a program to help seniors with the expenses of prescription drugs and she hoped that the program would help her.  Ann knew that she didn't use too many prescriptions, not like some her friends that spent as much in one month on prescription drugs as she spent in an entire year, $1,500.

Regardless of the amount, Ann wanted some help with her $1,500 annual prescription drug bill because she had no insurance coverage for prescription drugs and the $125 per month for her drugs came right off the top of her $800 per month Social Security check. It was getting harder and harder to make the remaining $675 get all the way through the month and sometimes there was more month than there was money.

Ann liked what she thought that she understood about the Medicare program because it looked like it could save her about $500 per year. Ann contacted a local social service agency and asked about assistance programs that were available to help her pay for this prescription drug program. They asked her about her income and when she told them that her total monthly income was just a little over $800 per month, they told her that her income qualified her for the full subsidy program in the program. Ann was delighted, for a moment, and then they asked her about her assets and she told them about the $27,000 in CD's and as they responded, her excitement turned to great disappointment. The $27,000 in CD's, the last of Ann and George's savings for old age, was now disqualifying her from receiving any help toward the payment of the program's costs. One moment it looked like she would save almost $100 per month and the next no help at all. Ann was really disheartened!

Ann's son looked at the situation and thought that there must be a way to get her help and he called me.  Ann and her story started a mission to examine and understand the real rules on qualification for help to pay for the costs of this program. A program that is supposed to help senior citizens afford the increasing costs of prescription drugs!

What is a resource like this worth?

Let's look at Ann's situation again.  She was spending $1,500 per year out of her pocket for drugs. The base plan, without subsidy, will save her almost $500 per year. The "partial subsidy", which was her choice, will save her an additional $720 per year over the base plan. Stated differently, Ann will be saving an additional $60 per month, compared to her savings on the base plan, by becoming eligible for the "partial subsidy" amounts for Part D. One way to determine what a stream of income is worth is to calculate the amount of money that would have to be held in deposit at a financial institution to create the income stream. It would take $30,000 at 4% annual interest to create $100 per month of income.

Look at the asset amount or the monthly savings and you are looking at significant savings!

Another way to look at the value of something is to determine the replacement cost or what would it take in time and money to get to the conclusion yourself. The probable place that you would go to gain assistance is an attorney that is familiar with this or similar areas of law. Depending on where you are in the country, hourly rates for attorneys with this knowledge would likely be in the $200 to $400/hour range. Taking the mid point of $300/hour and making the assumption that you would probably be charged for around three hours minimum, the attorney's bill would be $900.
